GENERAL TERMS OF USE DIGITAL EXPERIENCE "Max Mara Le Parfum"
These terms apply to any user of the website www.maxmara.com [LL1.1](hereinafter the "Website") wishing to access the Max Mara Fragrance experience offered by the Website.
The Website is published by Max Mara S.r.l,[LL2.1] Single-Member Company Gruppo Max Mara, with share capital of EUR 13,000,000, having its registered office at Via Giulia Maramotti 4, 42124, Reggio Emilia, Italy, REA: Reggio Emilia No. 182471, Company Register of RE, Tax Code and VAT No. 01397620350, Intra-Community VAT No. IT01397620350 (hereinafter together the "Organizing Company").
BEAUTE PRESTIGE INTERNATIONAL (trading name SHISEIDO EMEA), registered with the Paris Trade and Companies Register under No. 379 445 984, with its registered office at 57 rue de Villiers 92000 Neuilly-sur-Seine, provides users of the Website with a digital experience (hereinafter the "Experience") to discover Max Mara Fragrance as of August 24, 2026.
ARTICLE I:
This Experience is governed in its entirety by the provisions set forth in these general terms of use, to which all users of the Experience agree (hereinafter referred to as the "GTCU").
ARTICLE II:
The Experience is open to any person over 18 years old accessing the Website and wishing to participate (hereinafter referred to as the "User" or collectively the "Users").
The Experience is not intended for persons under 18, except with parental or guardian authorization. We are unable to verify whether a website user is a minor; therefore, we encourage parents and guardians to be involved in their children’s online activities.
Use of the Experience constitutes full, express and unconditional acceptance of these GTCU, as well as applicable laws and regulations in France.
ARTICLE III: PRESENTATION OF THE EXPERIENCE
The User is invited to enter the Experience via a link on the Website. The User can explore “Max Mara Le Parfum” universe and view media to unlock three (3) digital items (or reel) allowing them to create a personalized wallpaper that can be downloaded and shared on social networks.
Any fraudulent, dishonest, harmful, or offensive use of the Experience or any elements available on the Site is prohibited. Any violation will be subject to legal action by the Organizing Company or by BEAUTE PRESTIGE INTERNATIONAL against the User.
ARTICLE IV – INTELLECTUAL PROPERTY RIGHTS
BEAUTE PRESTIGE INTERNATIONAL owns all intellectual property rights relating to the Experience. These rights belong to them, or they hold the related rights of use and/or exploitation. Access to and participation in the Experience does not grant the User any rights to these intellectual property rights, particularly for commercial uses or uses not authorized by the rights holder.
Therefore, it is strictly forbidden to reproduce, represent, modify, transmit, publish, adapt, on any medium whatsoever, by any means whatsoever, or exploit in any way whatsoever, the elements relating to the Experience, without the prior written authorization of BEAUTE PRESTIGE INTERNATIONAL.
It should be noted that, within the framework of the Experience, the User is authorized to share the Scrapbook generated by the Experience on social networks, under the conditions set forth in these Terms and Conditions and without infringing upon the rights holders.
ARTICLE V:
The Organizing Company reserves the right to modify or cancel the Experience without liability in cases of force majeure or if circumstances beyond the control of the Organizing Company so require, without incurring any liability as a result.
More generally, the Organizing Company cannot be held liable in cases of force majeure or unforeseen events beyond its control. Nor can it be held responsible, and no legal action may be taken against it, in the event of force majeure or unforeseen events caused by a third party. Similarly, neither the Organizing Company, nor BEAUTE PRESTIGE INTERNATIONAL, nor its service providers can be held liable for any incidents occurring during the use of the Experience.
ARTICLE VI:
For all information relating to personal data that may be collected by the Organising Company in connection with the Experience, Users can refer to the Privacy Policy accessible on the Organising Company's Website.
ARTICLE VII:
Any difficulty in interpreting or applying these GTCU will be resolved by the Organizing Company and/or BEAUTE PRESTIGE INTERNATIONAL in accordance with French law. Any User behavior that may harm the image of BEAUTE PRESTIGE INTERNATIONAL, the Organizing Company, and/or is contrary to public order and/or morality may result in sanctions and legal action. The Organizing Company may, at its sole discretion and without prior notice, exclude any User who has not complied with these GTCU.
Should any clause of these GTCU become null and void due to a change in legislation, deregulation, or a court decision, this shall not affect the validity and enforceability of the remaining clauses.
ARTICLE VIII:
These GTCU are governed by French law. Paris courts have exclusive jurisdiction.
The courts of the jurisdiction of Paris shall have sole jurisdiction to deal with any dispute relating to the validity, application or interpretation of these GTCU.
